How did it end?
The proposal of the EU Commission – a ban on the use of natural CBD extract from industrial hemp.
In October of this year, we learned that the European Commission submitted a proposal for technical hemp extracts. According to preliminary position, natural industrial hemp extract should be considered as drug / narcotic psychotropic substance and thus without the possibility of its use in the public domain, even if it contains only legal cannabinoids, including CBD, and does not contain unauthorized psychotropic THC. We have been actively fighting against this decision – we have also created an online petition that many of you have signed, and thank you very much for your support!
We waited with great tension for the decision of the European Court of Justice, and the result was sensational: the Court of Justice of the European Union ruled that CBD cannot be considered a drug and that CBD products have the equivalent rules for the free movement of goods between Member States as other legal products.
In particular, the Court held that:
- Hemp flower extract is not considered a narcotic drug in the 1961 United Nations Single Convention on Narcotic Drugs.
- A Member State may not prohibit the placing on the market of CBD legally produced in another Member State if it is derived from the Cannabis Sativa plant, including inflorescences.
- France must provide scientific evidence of the dangers and risks associated with CBD if it decides to maintain the current ban on the marketing of products containing CBD.
France and the CanaVepe case
This is a dispute between the former leaders of a French-Czech company that supplied the French market with an electronic cigarette with hemp essence under the brand name KanaVape. Cigarette oil was produced in the Czech Republic from whole cannabis plants, including leaves and flowers. However, in France, only cannabis leaves and seeds are allowed for commercial use.
According to the court, the basis for the production of the oil was cannabidiol (CBD), one of the hemp molecules that does not have psychotropic effects. Therefore, according to the company, the cigarettes did not contain tetrahydrocannabinol (THC), which is the main psychoactive substance found mainly in cannabis flowers.
A French court in a dispute involving a pair of employees of the company since 2014 gave suspended sentences and a fine of 10,000. Whole plant CBD produced in another country, EU laws.
The decision of the EU court is welcomed by buyers, sellers and farmers.
The fact that customers will still be able to safely buy CBD products in the EU is good news for them. They contact us all the time saying that they can’t imagine the market without CBD products… We are very happy that we are involved in this and make CBD hemp much more accessible to them.
At the same time, farmers and food business operators will not be deprived of market opportunities that can generate significant income in these times of crisis.
